The freedom of speech is one of the crucial features of the democratic society. The personal liberty cannot be achieved without the ability to express your thoughts freely. It also means the opportunity to participate in the discussions and debates. George Orwell said, “If liberty means anything at all, it means the right to tell people what they do not want to hear”.

The media is a powerful mean of social progress nowadays. It is said that social media’s worldwide audience gives individuals new rights, responsibilities, and risks. Joshua Rozenberg claimed, “A tweet is not an email, it’s a broadcast”. The aim of this essay is to present my own opinion on the expressions by Orwell and Rozenberg and to discuss the influence of media on the human rights, responsibilities, and risks.

The social media represents the source and the mean of the information dissemination. It is difficult to imagine what the world would look like if we did not have the media. The dissemination of the true information is one of the pillars of the free society.

Nowadays, the breakthrough in this process has been achieved due to the development and implementation of the new media and information and communications technologies (ICTs) ( IMS Conference on ICTs, 2008). I agree with the statement of George Orwell, who said that the liberty “means the right to tell people what they do not want to hear”.

It goes without saying that all people are different and, thus, their views on the changes occurring in the surrounding world differ. However, the social progress cannot be achieved without the conflict solving and decision making. The availability of the different opinions contributes to the arriving at the best solution. The freedom of speech implies the opportunity of the unhampered expression of the opposite views.

How can we say about the liberty and personal freedom if we are afraid of protesting and arguing? The truly democratic society is the one, which encourages the independent thinking and the expression of the opposite views.

Katharine Gelber in her article ‘Freedom of Speech and Australian Political Culture’ considers the opinions of the Australian politicians, representing both the Coalition and Opposition in the beginning of the 1990s. Gelber tries to say that the history of the freedom of speech in Australia consists of the periods of the increasing public debates on the issue of human rights and their protection.

In 1992, the wide discussions contributed to the recognition of the freedom of speech in Australia (Gelber, 2011). Although the representatives of the various political parties have different views on the concept of freedom of speech, all of them indicate to its importance for the society.

Gelber says that the majority of Australians believe that the freedom of speech exists in the Australian society (Gelber, 2011). Undoubtedly, it shows that people feel their liberty in saying what the others do not want to hear.

There is a famous expression by Joshua Rozenberg, “A tweet is not an email, it’s a broadcast”. I think that he means that if the conversation includes more than two persons, it is public and it disseminates the information rapidly. In the context of the human rights, it can be said that the ‘tweet’ or wide discussions are vital for the dissemination of the information and contribute to the freedom of speech.

I agree with the statement that the social media’s worldwide audience gives individuals new rights, responsibilities, and risks. In this respect, censorship remains one of the most significant hazards. However paradoxical it looks at the first glance, the United States of America represents the bright example of the country with the freedom of speech, on the one hand, and the cases of censorship, on the other hand.

Patrick Garry in his book An American Paradox: Censorship in a Nation of Free Speech analyses the reasons for the existence of censorship in the country proclaiming the freedom of speech as one of the highest values. Garry finds the roots for this problem in the rapid dynamism of the American society.

The author also states that “as multiculturalism replaces the older, more traditional social model of Americanized homogeneity, speech and censorship will increasingly form the ethnic and cultural battleground of this change” (Garry, 1993, p. 14).

Undoubtedly, the freedom of speech is one of the most discrepant social and political issues. People’s words depend on their minds and their emotions. However, they are not always the positive ones and sometimes people are driven by hate. The history of mankind already has a lot of examples when the speech provoked the violence. The Nazi Germany is one of such examples.

The emotional speech of Adolph Hitler inspired millions of people to commit the crime against humanity. That is why it should be emphasized that the freedom of speech assumes the responsibility. It is said that “our most successful approach to defending our human rights and human dignity is to begin with the principle: Choose Love, Not Hate” ( Freedom of expression, no date).

Besides, it should be mentioned that the freedom of speech should not contradict the other human rights, including the intellectual property rights, the right to reputation, and others. The government intervention in the dissemination of the information should not go beyond the boundaries of the protection of the confidential information, reputation, public safety and order ( Freedom of expression, no date).

The debates provoked by the promulgation of the secret information by WikiLeaks shook the public. Although there were different views on the activity of the website, it is obvious that it made the confidential information public, thus, violating the right to privacy and supporting the freedom of speech.

According to Little, “there is a difference between disclosure of information relating to private lives of individuals and that relating to governments” (2013, par. 6). The European authorities support the freedom of speech but indicate to the importance of licensing of broadcasting and the verification of the information disseminated by the media ( Freedom of expression, 2007).

Connie Bennett and Rob Everett emphasize the importance of tolerance and understanding in the protection of the freedom of speech. At the same time, the authors state, “Free and open access to the universe of ideas not only enriches the lives of a country’s citizens; it protects them from the harm caused when ignorance and misinformation go unchallenged by facts” (Bennett and Everett, 2011, n.pag.).

The rapid development of the information technologies and the digital communication systems create the risks of inconsistent and false data dissemination as the role of the journalists and editors becomes vanished by the work of computers and Internet. At the same time, the modern technologies may help to overcome the bias in the information disseminated by the media.

There are a number of the social organizations aimed at protecting the freedom of speech and the activity of the journalists all over the world. In particular, Freedom House provides the support to the advocates of the human rights to defend the free media and the right to independent expression ( Freedom of expression, no date).

In order to sum up all above mentioned, it should be said that the freedom of speech is one of the main human rights. However, it remains one of the controversial social issues as well. The freedom of expression implies certain responsibilities including the respect to the privacy of other people as well as to the results of their intellectual activity.

The development of the information technologies changes the media and the communication systems. The new tendency creates both the opportunities for the facilitation of the freedom of speech and risks of the dissemination of the false information.

Now yes, social media, arguably, can cause harm. At the same time, it is important to understand that we also cannot simply do away with social media or live without it, given its importance.

In addition to the conflict between free speech and public health in connection with social media , the role of social media as a public health hazard in itself has gained attention.

Social Media’s Public Health Harms

In a New York Times essay published on June 17, 2024, the Surgeon General proposed a warning label for social media platforms. He based this proposal on a range of alleged public health harms caused by social media, especially among young users. Other health experts, however, have criticized broad assertions about social media’s harms as oversimplified.

Here, too, a conflict with free speech looms. In a 2021 article , my coauthor Wendy Parmet and I cautioned that “[c]urrent First Amendment doctrine has set public health regulation and protections for commercial speech on a collision course.” Our analysis focused on compelled warning labels on sugary beverages. Similar public health measures involve warnings on tobacco products. Whereas earlier textual warnings have long been displayed on cigarette packages, new graphic warnings have been tied up in litigation for well over a decade because of First Amendment concerns. Social media warning labels might suffer the same fate.

The Supreme Court’s 2018 decision in National Institute of Family and Life Advocates (NIFLA) v. Becerra shifted the balance further away from public health protection in favor of free speech. This case, involving compelled disclosures at crisis pregnancy centers, provided an important gloss on analyzing the level of protection for commercial speech. Historically, under Zauderer v. Office of Disciplinary Counsel , the standard of review for disclosure requirements was rational basis. At issue in Zauderer was a law compelling an attorney to “include in his advertising purely factual and uncontroversial information about the terms under which his services will be available.” (The “purely factual and uncontroversial” part will be of utmost importance in the public health context, as I’ll explain shortly.)

There is widespread disagreement among the federal courts about the types of disclosures to which Zauderer applies. Take graphic tobacco warning labels as an example. In R.J. Reynolds v. Food and Drug Administration (FDA) , the D.C. Circuit in 2012 held that a set of FDA-proposed graphic warning labels violated the First Amendment. The court rejected application of Zauderer , because the graphic warning labels at issue “do not constitute the type of ‘purely factual and uncontroversial’ information” to which Zauderer’ s rational basis framework applies. Instead, the court limited its application to statements that are factual and noncontroversial. By contrast, the Fifth Circuit in March 2024 held that a set of  graphic warnings on cigarettes—somewhat revised by the FDA since the earlier round of litigation—are subject to Zauderer and are both purely factual and noncontroversial.

In NIFLA , Justice Thomas, writing for the majority, characterized Zauderer as applying to “laws that require professionals to disclose factual, noncontroversial information in their ‘commercial speech’” and as “govern[ing] only ‘commercial advertising’ and require[ing] the disclosure of ‘purely factual and uncontroversial’ information about the terms under which . . . services will be available.” Finding Zauderer inapplicable, the NIFLA majority reinterpreted the “uncontroversial” requirement to encompass the entire topic of abortion. Such a broad interpretation could mean that as long as a topic is broadly controversial (such as abortion, perhaps various vaccines, and others), any information relating to it, even if it is factual and accurate, could be deemed controversial. What exactly makes a topic controversial, moreover, problematically remains unclear. At the same time, the Court sought to provide reassurance stating that “we do not question the legality of health and safety warnings long considered permissible, or purely factual and uncontroversial disclosures about commercial products.”

Examining the permissibility of compelled public health and safety warnings in light of NIFLA thus turns on the “purely factual and uncontroversial” inquiry as well as the question of what “long considered permissible” means.  Connecting the NIFLA majority’s understanding back to the contestation around the Surgeon General’s proposed social media warnings illustrates the potential for the proposal’s constitutional infirmity. To the extent that there is scientific disagreement about the harms social media causes, it is easily conceivable that warning labels may be considered controversial. And due to the novelty of social media, such warnings may not be “long considered permissible.” Here, the doctrinal uncertainty surrounding First Amendment review of compelled commercial disclosures prior to and after NIFLA comes into sharp relief.

These three snapshots of current disputes highlight the potential for further conflict between free speech and public health, particularly on social media platforms. Across a range of areas, public health measures must take into account an expanding interpretation of free speech protection. Social media will test the underlying assumptions of free speech protection and the doctrinal uncertainties that existed in the past will likely be exacerbated by social media applications.

It offers businesses a cost-effective way to promote their products and services to a global audience. At individual and government levels, everybody wants their data to be protected. From security concerns to mental health problems, social media brings a lot of disadvantages, which we often ignore.

That is why the passed by the Government of India ensures user safety and grants rights to data principals. This includes the right to know what personal data is processed, the right to data deletion, and the right to correct or update inaccurate personal data.

Social Media Impact on Students: Advantages and Disadvantages

Social media has had a big impact on reducing the ability of children to pay attention for long periods of time. The constant switching between different applications, videos, games, and messages trains the brains of young minds to have a short focus.

The youngsters grow accustomed to the quick bursts of novelty and the dopamine that social media provides them. Their minds get restless and easily get bored when they are asked to concentrate on something for more than a few minutes at a time. In the future, continuous reading, lectures, or work will become challenging for them.

The nature of multimedia sites like Instagram, TikTok, and YouTube overexcites the brains of children. Rapid receiving of fire streams of fresh content is designed to grab and keep their attention at all costs. All this overloads the senses and cognitive abilities of young minds.

Further, the apps also encourage endless scrolling and switching of content by auto-playing the next video or suggesting a new watch. Children develop the habit of constantly shifting their focus instead of concentrating on a single task.

However, social media also offers some benefits to children. It helps the kids generate new ideas and perspectives worldwide. It allows the young ones to learn about trending events and issues that society cares about. There are numerous tech videos that are created with the concept of being fun, engaging, and easy to learn simultaneously.

Further, social media also provides creative outlets for the children to express themselves through photos, videos, writing, and art. It allows them to develop interests and easily connect with people around them who share their passions.

As it said, excess of everything is bad; therefore, parents and teachers must guide children on the balanced use of social media. They should teach young minds to promote the habits of single-tasking and good focus. If it is not done, then the distracting nature of applications will increase the reduction in attentiveness.

In conclusion, social media comes with predominantly negative conditions as well as some positive sides. Proper guidance and a correct learning approach will help the child differentiate between the two in the correct manner and will help increase their ability to focus on whatever they do.

A little more than a year into Tim Walz’s first term as governor, he faced his biggest test.

His state, already in the throes of the Covid-19 pandemic, was suddenly in the international spotlight after a Minneapolis police officer was filmed murdering George Floyd in May 2020.

Looting, arson and violence followed, quickly overwhelming the local authorities , and some faulted Mr. Walz for not doing more and not moving faster to bring the situation under control with Minnesota National Guard troops and other state officials.

Two days after Mr. Floyd’s death, with protests in Minneapolis turning increasingly violent, the city’s mayor, Jacob Frey, asked Mr. Walz to deploy the National Guard. Hours later, the city’s police chief submitted a written request for 600 troops. But it was not until the next afternoon that Mr. Walz signed an executive order allowing the Guard to assist cities.

“It was obvious to me that he froze under pressure, under a calamity, as people’s properties were being burned down,” said State Senator Warren Limmer, a Republican who helped lead a committee that investigated the response to the unrest. He suggested that Mr. Walz’s personal sympathies toward protesters might have delayed a muscular response.

Mr. Walz, a Democrat who has been chosen as Vice President Kamala Harris’s running mate, has since defended his actions during those days, saying he and others in state government were acting in good faith amid unimaginable circumstances.

“I simply believe that we try to do the best we can ,” Mr. Walz said recently at a news conference when asked about his response to the riots.

Senate passes the most significant child online safety bills in decades

WASHINGTON — The Senate on Tuesday overwhelmingly passed a pair of children’s online safety bills — a rare sign of bipartisan cooperation in the middle of a volatile and acrimonious presidential campaign.

But the legislation won’t make it to President Joe Biden’s desk any time soon. The House has just begun its six-week summer recess and won’t return to Washington until Sept. 9. And while he supports the “purpose” of the bills, Speaker Mike Johnson, R-La., said he’s still reviewing the legislation and hasn’t scheduled a vote.

The two bills in the package — known as the Kids Online Safety Act , or KOSA, and the Children’s and Teens Online Privacy Protection Act, or COPPA 2.0 — are the most significant congressional action in decades to regulate social media’s impact on children and teens.

The lopsided vote was 91-3, with Senate Finance Committee Chairman Ron Wyden, D-Ore., and GOP Sens. Rand Paul of Kentucky and Mike Lee of Utah as the only no votes.

“This is why we came here — to get things done and do it in a bipartisan way that literally will save lives,” Sen. Richard Blumenthal, D-Conn., a former state attorney general, said in an interview last week. Blumenthal teamed with Sen. Marsha Blackburn, R-Tenn., on authoring KOSA.

“What we’re doing is giving parents and kids the tools to disconnect from harmful content, bullying, eating disorders, stuff that really hurts them, and also impose a duty of care on Big Tech that for too long has said ‘trust us’ and betrayed that trust,” Blumenthal said. “And now, they’re going to have to comply with a law that imposes a duty on them to mitigate or prevent harm.”

KOSA would require social media companies to better protect users under age 17. It also would require companies to provide guardians with more control over minors’ use of a platform and prevent certain features, such as autoplay. And it would require companies to give users dedicated pages on which to report harmful content.

COPPA 2.0, written by Sens. Ed Markey, D-Mass., and Bill Cassidy, R-La., would create stronger online privacy protections for anyone under age 17. It would also bar targeted advertising to kids and teens and create an eraser button for parents and kids by requiring companies to allow users to delete information.

Biden signed legislation three months ago that would  ban the video-sharing app TikTok  in the U.S. after the election unless its Chinese owner sells it.

Some tech companies, like Microsoft and Snap, the company that owns Snapchat, have endorsed KOSA. Meta, the parent company of Facebook and Instagram, offered suggestions about how to improve the bill, while some other social media companies have not taken formal positions.

“We support the development of age-appropriate standards for teens online, and appreciate KOSA’s attempt to create a consistent set of rules for the industry to follow,” a Meta spokesperson said in a statement. “However, we think there’s a better way to help parents oversee their teens’ online experiences: federal legislation should require app stores to get parents’ approval whenever their teens under 16 download apps.”

Opponents, including the American Civil Liberties Union and other free speech and civil liberties groups, argue that the bill’s definition of harm is too broad and that it could lead to censorship of content that promotes politically polarizing issues, gender equality or abortion rights.

“I fear this bill could be used to sue services that offer privacy-enhancing technologies like encryption or anonymity features that are essential to young people’s ability to communicate securely and privately without being spied on by predators online," Wyden said, explaining why he voted no.

But in recent months, Senate Majority Leader Chuck Schumer, D-N.Y., worked closely with Commerce Committee Chair Maria Cantwell, D-Wash., and the bills’ sponsors — Blumenthal, Blackburn, Markey and Cassidy — to address concerns and build support.

“Today, after a lot of hard work and a lot of twists and turns, we will pass KOSA and COPPA,” Schumer said in a floor speech Tuesday before the vote. “KOSA and COPPA will be perhaps the most important updates to federal laws protecting kids on the internet in decades. And it’s a very good first step.”

He said social media has benefits but also significant risks for children’s safety. He called on the House to quickly take up the package when it returns in September.

“These bills have real bipartisan momentum, so we should seize the opportunity to send them to the president’s desk,” Schumer said.

The Republican-led House, however, is looking to put its own mark on the legislation. Before the recess, Energy and Commerce Committee Chair Cathy McMorris Rodgers, R-Wash., said her full committee is “planning to move forward” with marking up both bills — a process that could include changes that would need to pass the full House and then the Senate again before they became law.

“It’s very important that Congress act,” McMorris Rodgers, who is retiring from Congress at the end of the year, said in an interview.

Meanwhile, Johnson appeared bullish about passing the bills through the House before this Congress ends in January.

“We’re looking at details of it. Obviously, I believe in the purpose of the legislation. I think it’s really important,” he said. “But there’s a couple of questions we have about the details, but I think we can work it out, and I’d like to get it done.”

KOSA was drafted after a series of emotional and powerful hearings focused on the harms of social media on young people. Parents testified about how social media had driven their children to commit suicide or led to other harm. And senators demanded that social media executives, including Meta CEO Mark Zuckerberg, apologize to the parents in the room as they held photos of their deceased loved ones.

Those parents made the case "that our children are not a product that can be exploited by these social media companies," Blackburn said in a joint interview with Blumenthal. "As we did hearings, they stepped forward, they told their stories. They came to us and they said, ‘Let us be a part of this. Let us help.’"
